Privacy policy

1. Who we are

This policy is issued by Faircode Infotech Pvt Ltd (“Faircode”, “we”, “us”). We design, build and operate software, product strategy, UI/UX, AI solutions, ERPNext implementations and IT staff augmentation from studios in Kochi, India, Austin, Texas and Dubai, UAE.

Where a signed statement of work names a related Faircode entity, that entity is the controller for data processed under that contract. This policy still describes how we handle personal data collected through faircodetech.com.

2. What this policy covers

It applies to personal data we collect when you:

  • browse this website or download materials from it;
  • send an enquiry, quote request or consultation request;
  • apply for a role or submit a CV; or
  • email, call or message us through the contact details published on the site.

Client systems we build or host under a separate contract are governed by that contract and any data-processing schedule attached to it, not by this website policy.

3. Information we collect

Information you give us. Enquiry and quote forms collect your name, work email, phone number, company, the service you need, estimated budget, project details and any files you attach (briefs, RFPs, wireframes). Career applications collect contact details, role applied for and the documents you upload. You may also write to us directly by email or phone.

Information collected automatically. When you visit the site we receive standard technical data such as IP address, browser and device type, referring URL, pages viewed and timestamps. We may set cookies or similar storage as described in our Cookie Policy.

Information from others. If a colleague or partner refers you, they may share your name, email and a short note so we can follow up. Public professional profiles (for example LinkedIn) may be used to confirm a business contact after you have reached out.

We do not ask for government ID numbers, payment-card data or special-category data through this website. Please do not include them in forms or attachments unless we have asked in writing.

4. Why we use it

We use personal data to:

  • respond to enquiries and send proposals, NDAs and follow-up;
  • create a lead record in our systems so the right person can reply;
  • assess applications and communicate about roles;
  • send materials you requested (guides, company profile, portfolio);
  • operate, secure and improve the website;
  • meet accounting, tax, employment and other legal duties; and
  • establish, exercise or defend legal claims.

We do not sell personal data. We do not use website enquiry data for unrelated advertising networks.

Depending on where you are and why we hold the data, we rely on:

  • Consent, for example when you tick the enquiry consent box or ask us to send a download.
  • Contract / steps prior to contract, to reply to a request for work, consider a job application, or to take steps you have asked for.
  • Legitimate interests, running a B2B website, preventing abuse, and keeping records of business conversations, balanced against your rights.
  • Legal obligation, where Indian, US, UAE or other law requires us to keep or disclose information.

For people in India this is consistent with the Digital Personal Data Protection Act, 2023. For people in the United States we honour applicable state privacy laws, including the right to know, delete and opt out of sale or targeted advertising (we do not sell data or run third-party ad tracking on this site). For people in the United Arab Emirates we handle personal data in line with applicable UAE data protection law.

6. Who we share it with

We share personal data only as needed to run the business:

  • Faircode team members in Kochi, Austin and the Middle East who handle sales, delivery, HR or operations.
  • Our ERP and email systems (including lead records created from the website form) so enquiries are not lost.
  • Hosting, cloud and communications providers that process data on our instructions.
  • Professional advisers (legal, accounting) under confidentiality.
  • Authorities when the law requires it, or to protect our rights, users or the public.

We do not share enquiry data with unrelated marketers. If a project later needs a subcontractor, we will do so under written terms that protect the data.

7. International transfers

Faircode operates in India, the United States and the Middle East. Personal data submitted on this site may be accessed from, and stored in, any of those regions (and in the regions used by our cloud providers). We take contractual and technical steps appropriate to the transfer, including access controls and the confidentiality terms we apply to staff and processors.

8. How long we keep it

We keep enquiry and quote records for as long as needed to handle the conversation and for a reasonable period afterwards (typically up to 24 months if no engagement follows), unless a longer period is required for a live project, dispute or legal duty. Career applications that do not result in hiring are kept only as long as needed to complete the process and any related legal hold. Server logs are rotated on a shorter cycle. When we no longer need the data we delete or irreversibly anonymise it.

9. Security

We use HTTPS, access controls, least-privilege accounts and confidential handling of attachments. No method of transmission or storage is perfectly secure. If we become aware of a breach that is likely to affect your rights, we will notify you and the relevant authority as the law requires.

10. Your rights

Subject to applicable law, you may ask us to:

  • access the personal data we hold about you;
  • correct inaccurate or incomplete data;
  • erase data we no longer need;
  • withdraw consent where processing is based on consent;
  • restrict or object to certain processing; and
  • nominate another person to exercise rights on your behalf, where Indian law allows it.

Email info@faircodetech.com with the subject “Privacy request”. We may need to verify your identity before acting. You may also complain to the Data Protection Board of India or to a US state attorney general, as applicable.

11. Children

This website is intended for business users and job applicants. We do not knowingly collect personal data from children under 18. If you believe we have, please contact us and we will delete it.

12. Cookies

We use cookies and similar technologies that are needed to run the site, remember basic preferences and understand how pages are used. Details, including how to refuse non-essential cookies, are in our Cookie Policy.

13. Changes

We may update this policy when our practices or the law change. The “last updated” date at the top will change, and the current version will always be at /legal/privacy-policy. Material changes will be highlighted on this page.
